There is a different understanding of whether the problems in the promotion and application of new energy vehicles are “scamsâ€. Our preliminary analysis believes that the "cheat compensation" behavior is mainly in three aspects, namely, the unproductive or false report of the certificate, the inconsistency between the product and the key parameters of the "Announcement", and the reuse of the application subsidy after the battery is disassembled, basically as follows.
(1) Unproduced or falsely reported vehicles
According to the relevant regulations on the production of motor vehicles, vehicles must have a unique vehicle identification code before registration, and should have a certificate of conformity. Article 9 of the Law of the People's Republic of China on Road Traffic Safety stipulates: "When applying for motor vehicle registration, the following certificates and vouchers shall be submitted: the identification of the owner of the motor vehicle; the certificate of the origin of the motor vehicle; the certificate of passing the vehicle or the imported machine Motor vehicle import certificate; tax payment certificate or tax exemption certificate for vehicle purchase tax; other certificates and vouchers that should be submitted at the time of registration of motor vehicles as required by laws and administrative regulations. Article 10 stipulates: “Motor vehicles approved for registration shall comply with the national safety of motor vehicles. Technical standards. When applying for motor vehicle registration, the safety technical inspection of the motor vehicle should be accepted. However, the new vehicle of the model is manufactured at the factory after the motor vehicle type produced by the enterprise approved by the national motor vehicle product authority according to the national safety technical standards of the motor vehicle. If the time-test is in compliance with the national safety technical standards of motor vehicles, and the inspection certificate is obtained, the safety technology inspection shall be exempted."
Some enterprises have falsely reported vehicle certification, falsely reported production, and even issued licenses and applied for subsidies. They did not comply with relevant state regulations in the process. If they belong to unproduced vehicles, they apply to the state for registration and apply for financial subsidies. This type of behavior is a "cheat" behavior. The judgment is based on whether the vehicle has been completed before the new car is on board, that is, whether the vehicle is sold and the subsidy is applied without the car. For example, the sales volume (registration volume) of Suzhou Jim West is greater than the production volume. If it is not produced, it will be licensed and applied for subsidies; more than 100 registered vehicles of a certain enterprise in South China have not yet completed production off-line.
(2) The product is inconsistent with the key parameters of the Announcement
In June 2010, the Ministry of Industry and Information Technology formulated the “Measures for the Supervision and Administration of Vehicle Production Enterprises and Product Production Consistency†according to the “Decision of the State Council on Establishing Administrative Licensing for Administrative Approval Items Needed to Be Retained†and “Automobile Industry Development Policyâ€. Supervision and management of vehicle production enterprises and product production consistency in the Announcement. Among them, Article 3 stipulates: “The vehicle production enterprise is the responsible body of production consistency management. It is necessary to establish and improve the production consistency management system to ensure the consistency of vehicle products, that is, to ensure the relevant technical parameters and configuration of the actual production and sales of vehicle products. And performance indicators, consistent with the relevant technical parameters, configuration and performance indicators in the vehicle products approved by the Announcement, the vehicle samples used for testing, the product "certificate" and the factory vehicle upload information. "Article 8: "Vehicles The production enterprise can take the initiative to apply to the Ministry of Industry and Information Technology for production consistency supervision and inspection. After inspection, the vehicle production enterprise that meets the requirements of production consistency can apply for exemption from the registration of the vehicle after the registration of the vehicle and the Ministry of Industry and Information Technology. "Safety technology inspection." Article 10 stipulates: "For vehicle production enterprises that cannot guarantee the consistency of production of products, the Ministry of Industry and Information Technology will take notices, rectify, suspend or cancel the inspections within a time limit according to the circumstances. 'Record, suspend or revoke the related products "Announcement" and other measures."
The "Notice on Continued Development and Application of New Energy Vehicles" jointly issued by the four ministries clearly stipulates that the subsidy standard is determined based on the base price difference between new energy vehicles and similar traditional vehicles. Among them, pure electric passenger cars and plug-in hybrid passenger cars are based on pure electric driving mileage. For pure electric passenger cars and plug-in hybrid (including extended-range) passenger cars, they are subsidized according to their length. In April 2016, the “Notice on the Financial Support Policy for the Promotion and Application of New Energy Vehicles from 2016 to 2020†issued by the four ministries and commissions clearly clarified the supervision and verification of the promotion of new energy vehicles. For the provision of false technical parameters to defraud the product subsidy; provide false promotion information to defraud financial subsidy funds; the key parts model, battery capacity, technical parameters of the products sold are inconsistent with the "announcement" products, will be notified according to the circumstances, Deduct the subsidy funds, cancel the eligibility for new energy vehicle subsidies, suspend or eliminate the penalties for the products in the “Recommended Model Catalogueâ€. If the actual technical parameters, configuration and performance indicators of the relevant promotion and application models of the enterprise are not consistent with the relevant indicators approved by the “Announcementâ€, the enterprise shall obtain a higher subsidy, by falsely reporting the driving mileage, battery parameters, vehicle length (bus), etc. Indicator information, applying for financial subsidies, is in violation of the relevant provisions of the State "Announcement" management, the financial subsidy funds obtained by enterprises are illegal income, which is a "cheat".
(3) Reusing the application subsidy after disassembly and assembly of the battery
In the "cheat" of new energy vehicles, the battery of the vehicle has become a key carrier of "cheat". In new energy vehicles, because the main components of vehicles, seats, power batteries, tires, etc. cannot be traced uniquely, there is room for unscrupulous companies to profit by disassembling and reselling these components. Among them, the battery serial number and the frame number are not strong, and it is difficult to respond one by one. Many of the vehicles can use the same battery, which causes some enterprises to apply for financial subsidies through battery disassembly and reuse.
The new energy vehicle battery will be reused after disassembly and disassembly. According to the "Measures for the Supervision and Administration of Vehicle Production Enterprises and Product Production Consistency" and the "Notice on the Financial Support Policy for the Promotion and Application of New Energy Vehicles from 2016 to 2020", the products do not conform to the product. Sexual requirements violate the relevant regulations of the State's "Announcement". At the same time, enterprises applying for financial subsidies also violate the subsidy policy requirements, and the financial subsidies obtained are illegal income.
